Who pays customs duty on Taobao orders — and how much?

Updated 2026-10 · ProxyBao editorial

Possibly, and no agent can promise otherwise. Duty depends on the destination country, the product classification and the declared value. What an agent can do is estimate the amount, tell you who is responsible, and give you the documents you need if customs asks questions.

The rule that changed in the US

For years, shipments under $800 entered the United States without duty under the de minimis rule. That exemption ended on 29 August 2025 for most postal shipments from China. If you are shipping to the US today, assume duty applies from the first dollar.

How duty is calculated

Customs classifies the product with a commodity code, applies the tariff rate for that code, and adds taxes such as VAT or GST where the destination charges them. The declared value is usually the transaction value, not the shipping cost.

Two identical-looking products can have different rates because of material, function or packaging. That is why a generic percentage estimate is only a budget figure.

What the estimate on your quote means

The duty line in a quote is an estimate using a simplified rate for the destination country. It is there so you are not surprised, not because the site has made a customs ruling. The border authority has the final say.

If the actual duty is higher, the recipient normally pays the difference. If it is lower, the difference should be returned or credited. Ask how an agent handles both directions before you order.

Duty advance: when it helps

Some carriers refuse to release a parcel until duty is paid, and some recipients cannot pay the courier directly. A duty advance service pays the amount upfront and bills you later. It is a cash-flow service, not a discount, and normally carries a handling fee.

FAQ

Can I avoid duty by marking the parcel as a gift?

No. False declarations are customs fraud. They also void most carrier insurance and can lead to seizure.

Is duty included in the price I pay the agent?

Only if the checkout explicitly says duty is prepaid. An estimate is not a prepayment.

Who is legally responsible for the declaration?

The importer of record, which is normally the recipient. The agent prepares documents, but the declaration is made in your name.
